Debt Validation Letter - Sample Letter To A Collection Agency
A debt validation letter should be the first letter you send to a collection agency when initially contacted by a debt collector in reference to a so called debt that you owe them. The goal is to make sure they have the legal rights to collect money from you.
Imagine a situation where you paid the debt collector and a few months later the original creditor called you in reference to the debt, telling you that you still owe and they were not affiliated with the so-called debt collector you paid some months earlier.(continued below)
Debt validation is your right according to the fair debt collection practices act. It was put in place to protect consumers when dealing with collection agencies, and to also make sure they work in fairness when going about the process.
It is important to note that you have 30-days from the initial communication from the collection agency to send your debt validation letter in order for your rights to be protected.
Here is a sample debt validation letter you can send to a collection agency that recently contacted you in reference to a debt which they say you owe them:

To Whom It May Concern,
My name is William Martin and I am writing you in reference to the debt which you recently contacted me about and claim that I owe. This letter is not a refusal to pay but I have never done business with your company and not sure if you are legally empowered to collect any monies from me in reference to the debt mentioned in your letter to me.
According to the fair debt collection practices act, 15 USC 1692g Sec. 809 I have the right to dispute this debt. I am exercising that right by sending you this letter and would like you to send me the following as verification of the debt:
• Name and address of the original creditor
• How you calculated the amount you say I owe you
• License that you are legally able to operate in my state
The fair debt collection practices act requires that you cease all collection efforts in reference to this debt until you send me the results of validating this debt. If during the validation your company places derogatory or negative information on my credit report I will consult with my lawyer for further legal actions.
If your offices fail to respond to this matter within 30 days of receipt of this letter then all references to this account should be deleted from my credit reports. I would also like to inform you in this letter that communication with anyone other than my spouse, or lawyer is not allowed by law and would like you to respect my legal rights in regards to this matter.
All communication with me should be done in writing, at the address in this letter. This letter is again an attempt to correct your records in reference to an account which I am legally disputing.
